ControversiesHimanta Biswa Sarma's Attacks on the Chowdhury Family

There was a series of public attacks on AJP candidate Kunki Chowdhury and her family by the Assam Chief Minister Himanta Biswa Sarma during the election campaign. In a media interview, Sarma alleged that the mother of Chowdhury, Sujata Gurung Chowdhury had offended the feelings of Sanatani people by her activity on social media. He further claimed that she was a sympathiser of Pakistan, anti-national people, and was publicly eating beef. To go with the beef allegation, Sarma presented a photo in front of journalists. Sujata Gurung Chowdhury, in turn, filed a complaint with the National Commission for Women against the Chief Minister. The complaint declared his entire complaint totally false, unfounded and malicious. She has said that the picture that Sarma showed was the one taken in the International Church of Cannabis, Denver, Colorado. It was an artistic prop in the shape of a conical cylinder that was not a food item. Denver, Elevation Ministries, released a press statement that the item was a pillow that was part of a museum display, not meat of any sort. Sarma also alleged during the campaign that Chowdhury had openly popularized the use of social media by her mother who had been posting in support of Umar Khalid and Sharjeel Imam. Sujata Gurung Chowdhury referred to herself in the complaint as a private person with no political involvement in electoral politics, only being involved in the controversy because her daughter was running in an election in Assam Assembly in Guwahati Central constituency. The complaint also included that her personal photographs, as well as those of her minor son, had been shared extensively on social media without permission following the comments made by Sarma. Unknown people and social media accounts also spread manipulated pictures and artificial intelligence-generated content to tarnish her reputation. The complaint alleged that these actions created such intense mental torture to her and her family that election norms were violated in the Guwahati Central constituency around the polling day silence in the run-up to 9 April.

FIR and Police Action for Alleged MCC Violations

Assam Police filed an FIR against AJP candidate Kunki Chowdhury and her campaign workers on 9 April accusing them of breaching the election norms in the Guwahati Central constituency on Police have detained three of her team members all Haryana based, in the early hours of Friday following the end of voting. Central Guwahati DCP Shambhavi Mishra verified the arrests and reported that a complaint had been lodged claiming egregious violations of the Model Code of Conduct. According to election regulations, external political workers have to go 48 hours before polling. The Haryana three along with that of Chowdhury stayed in his campaign team after that deadline. Investigators also accused Chowdhury of going into a polling station in a group with which he communicated with voters in a way that might have affected the electoral process. The cars associated with the candidate were detected in restricted areas around polling points. In the police also provided charges of illegal entry of security staff into polling stations and digital outreach action throughout the silence period, with video recordings as evidence. On Saturday the police had summoned Chowdhury under section 35(3) of the Bharatiya Nagarik Suraksha Sanhita to appear at Pan Bazar police station where she was questioned. The case was filed on BNS under the sections of obstruction of order of a public servant, undue influence/personation in an election, and infringement of the Representation of the People Act. On Sunday, Chowdhury went to the police station and made her statement. She described the FIR as fake and politically driven, and said that her campaign had adhered to all the rules of the Election Commission. The president of AJP Lurinjyoti Gogoi termed the act as administrative pressure on a candidate and accused the BJP of politically misusing the police.
