  • Gajendra Singh Yadav, who identified as a follower of Lord Shiva and was a visitor to Sri Kashi Vishwanath Temple in Varanasi, Uttar Pradesh, filed a Public Interest Litigation (PIL) in 2021 asserting that the temple’s board of trustees’ decision to implement a Sugam Darshan system violates the fundamental rights of devotees guaranteed by Articles 14, 15, and 26 of the Indian Constitution. He said that the common people’s ability to practise their religion and exercise their right to worship had been restricted by the board of trustees’ provision of a special Sugam Darshan facility to only those who made a particular financial contribution. Vineet Sankalp, a trustee and member of the board, drew the court’s attention to Section 15 of the 1983 Act, which grants the board the authority to charge set fees for any worship, service, ritual, ceremony, or religious observance held in the temple. According to Vineet Sankalp, the Sugam Darshan Scheme was established to grant the freedom to worship to those with physical disabilities and those who could not stand in a line, rather than to bar all other worshippers from engaging in religious activities. On 2 December 2022, the petition against VIP darshan under the Sugam Darshan Scheme at the Kashi Vishwanath Temple was dismissed by the division Bench of Justice Manoj Misra and Justice Sameer Jain.
