Controversies• Criticized for his comments regarding the migrant labourers case:
In 2020, Mehta made an official statement regarding the Suo Motu petition for the problems of migrant laborers in Supreme Court. In his statement, Tushar Mehta blamed former Supreme Court judges, senior lawyers, historians, writers, and activists for exaggerating the issue. His statement was regarded an attempt to divert attention from the actual issues before the court. • Accused of criminal misconduct:
In 2021, a group of MPs from the Trinamool Congress (TMC) party met with the then-president of India Ram Nath Kovind and asked him to take an action against Tushar Mehta for his “criminal misconduct” and “gross impropriety” for meeting BJP MLA Suvendu Adhikari who is an accused in the 2016 Narada tapes case. Later, Mehta claimed that although Adhikari tried to meet him, he was unable to do so. [2]NDTV

• Criticized for his comments in the Same sex marriage recognition case:
In 2023, a five-judge bench refused to give legal recognition to same-sex marriage and same sex joint adoption of children stating that it was an issue for the parliament to decide. Later, Mehta was highly criticized for making statements during the proceedings of the case. During the proceedings, he said that,

  • At the age of 12, Tushar Mehta moved to Ahmedabad, Gujarat, after his father passed away.
  • After completing his graduation, he began practising law at the Ahmedabad High Court in 1987. He worked as a Civil and Criminal Lawyer.
  • In 1988, he began working as an apprentice under a senior advocate in the Gujarat High Court, Krishnakant Vakharia.
  • In 2000, Tushar Mehta started working at the Ahmedabad District Cooperative Bank. At the time, the BJP senior leader Amit Shah was the president of the bank. Tushar Mehta began working closely with Amit Sah and both discussed and drafted petitions together.
  • Tushar Mehta worked with Krishnakant Vakharia until 2004, and later, established his practice.
  • In 2007, he was appointed as a senior advocate of the High Court of Gujarat. Later, he was appointed as an Additional Advocate General by Gujarat’s Minister of State for Home and Law.
  • He has also served as a visiting faculty Lecturer at the Motilal Nehru Law College and Vivekanand Law College in Ahmedabad.

  • According to various reports, the Karnataka government paid Rs. 39.60 lakh to Tushar Mehta for arguing the hijab matter in the apex court on behalf of the Karnataka government. Mehta appeared 9 times in the court for the case.
  • In 2023, Mehta represented the Union government in the Abrogation of Article 370 case. He fought against various organisations and NGOs who filed petitions against the central government for their decision to abrogate Article 370.

  • In August 2024, a video of Tushar Mehta went viral. The video was of the case proceedings regarding the rape-murder of a trainee doctor by a civic volunteer of the police, at the RG Kar Medical College and Hospital in Kolkata. In the video, Mehta is seen disciplining a former Congressman and senior lawyer Kapil Sibal representing the West Bengal government.
  • In the case, Tushar Mehta was representing the CBI when the opposition lawyer laughed, and in response to that, Mehta said,

    A girl has lost her life in the most inhuman and undignified manner. Somebody has died. Do not at least laugh.”
