Breach of the Model Code of Conduct
In April 2014, Kirit Somaiya, the candidate representing the Bharatiya Janata Party (BJP), was accused of violating the model code of conduct in a complaint filed at the Bombay High Court. The complaint was lodged by Nikunj Dave, a resident of the constituency. Dave alleged that Somaiya, who was running for the Mumbai North-East constituency, solicited votes based on factors such as caste, community, and language preferences. Accusation of Defamation by Sanjay Raut
On 12 June 2023, Sanjay Raut, a Member of Parliament and leader of the Uddhav Thackeray faction of Shiv Sena, lodged a criminal defamation complaint against Kirit Somaiya with a Mumbai court. The complaint was prompted by Somaiya's tweets specifically targeting Raut. Raut alleged that Somaiya had been consistently posting defamatory statements on Twitter since 2022, which were baseless and aimed at tarnishing his reputation. Raut emphasized that the tweets in question were still accessible on Somaiya's social media page, adding weight to his accusation. Raut sought the intervention of the Magistrate in Mulund, Mumbai, urging them to recognize the offenses committed under sections 499 and 500 of the Indian Penal Code and summon Somaiya as the accused in this criminal defamation case. Allegations of Financial Misappropriation
In a case filed in 2022, Kirit Somaiya was accused of misappropriating Rs 58 lakh, which was collected through crowd-sourcing efforts to save the INS Vikrant, India's first aircraft carrier, from being scrapped. Accused Shiv Sena Activists of Assault
In April 2022, Kirit Somaiya found himself at the center of a controversy when he claimed to have been physically attacked by a group of 70-80 Shiv Sena activists. The incident occurred outside the Khar police station in Mumbai, where Somaiya had gone to meet Amravati MP Navneet Rana and her husband MLA Ravi Rana, who were under police custody at the time. Somaiya alleged that the Shiv Sena activists pelted stones, bottles, and footwear at his car during the incident.
