On 29 July 2016, he got arrested from the Buxar district of Bihar and was kept in judicial custody in Mau, Uttar Pradesh. His then-wife, Swati Singh lodged an FIR against the leaders of BSP for threatening their 12-year-old daughter and her mother-in-law under sections 120B (punishment for criminal conspiracy), 153 A (promoting enmity between different groups), 504 (intentional insult with intent to breach peace), 506 (punishment for criminal intimidation) and 509 (word, gesture or act to insult the modesty of a woman) of the IPC in August 2016. After the FIR filed by his wife, Daya Shankar was released from the custody on 6 August 2016. [3]Hindustan Times When his wife, Swati Singh won the 2017 assembly election in Uttar Pradesh, suspension on Daya Shankar was revoked by the Bharatiya Janata Party and he rejoined the party.
