Controversies• Age-forging allegations
Governor Suraj Bhan removed Samrat Choudhary from the Rabri Devi Cabinet in November 1999 on the grounds that he was underage. Bhan cited Article 164 of the Constitution, which implies that in order to be appointed as a minister, a person should have reached the age 25 to be a member of the state Legislative Assembly and 30 to be a member of the state Legislative Council. Governor Suraj Bhan also directed the state government to initiate repayment of all salary and benefits that Choudhary had received since his appointment as a minister, as well as to file a case of fraud, forgery, and misrepresentation against him. The dispute started with a petition that Samata Party leaders Raghunath Jha and P.K. Sinha filed with the state's Chief Electoral Officer (CEO), A.K. Basu, and the then governor, Justice B.M. Lal. The petition claimed that Choudhary was too young to be a minister because he hadn't turned 25. Lal had given Basu a 25-day period to investigate the matter and submit a report. Lal eventually retired, but when Suraj Bhan told the CEO to submit the full report by 5 November 1999, the issue resurfaced. Basu in his report to the governor mentioned that Chaudhary had not cooperated with the investigators and stated,

"The minister failed to prove that he has attained the age to be an eligible minister."

• Criminal cases against Samrat Choudhary
Samrat has been charged under 2 sections of IPC, IPC Section-171F which is a charge related to undue influence or personation at an election, and IPC Section-188 which is a charge related to disobedience to order duty promulgated by a public servant.

• Controversial statement
Samrat Choudhary made headlines in August 2023 when he made a controversial comment on the show Tulsi Ke Ram. He declared that he would not recognise 1947 as the official year of India's independence and claimed that the country's actual independence came about as a result of the Jayaprakash Narayan-led Sampoorna Kranti (Total Revolution Movement) in 1977. Later on, this caused a number of ministers to doubt Samrat Choudhary's knowledge.
