In March 2023, an FIR was filed against Manish Kashyap for spreading fake news about beating of migrant workers of Bihar in Tamil Nadu through his channel Sach Tak News and other social media handles. The FIR number 03/2023 was registered in the Economic Offences Unit, Patna, Bihar under the IPC sections 153, 153 (A), 153(B), 505(1)(B), 505 (1)(C), 468, 471, 120(B), and IT Act 67. Many politicians and social workers of Bihar and other states condemned this action and asked the state government to withdraw the FIR. Later, a fake post claiming that he was arrested spread out with an old photo of Manish Kashyap in which he was arrested and seen wearing handcuffs got viral. Bihar Police lodged a new FIR in regard to this and posted on its Twitter handle that this is fake, and Manish was not yet arrested.

He went on a tirade against Deputy CM of Bihar and Lalu Prasad Yadav's son Tejashwi Yadav, accused him of engineering the case against him and threated him that he will not allow Tejashwi to become Chief Minister of Bihar in the 2023 Bihar Assembly elections. He added that in case, Tejashwi becomes the CM, he will make the government fall in 180 days.

Sent to police custody in fake videos case: On 18 March 2023, he was arrested by Bihar Police’s economic offences unit (EOU) after he surrendered at Jagdishpur police station in cases related to fake videos of alleged assaults on migrant workers in Tamil Nadu. On 30 March 2023, a Madurai court sent him to police custody for three days.
